Welcome to Emotix ("we," "our," or "us"). By accessing or using our website, services, and AI team platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use our Services.

2. Account Terms

To access certain features of our Services, you may be required to register for an account. By registering, you agree to:

• Provide accurate, current, and complete information during the registration process.

3. Service Usage & AI Agents

Our Services enable you to create, configure, and interact with AI agents to generate content, analyze data, and perform tasks ("Output").

3.1 Input and Output

You represent and warrant that you have all necessary rights to the content you upload or input into the Services ("Input"). As between you and Emotix, and to the extent permitted by applicable law, you own all right, title, and interest in and to your Input and the resulting Output.

3.2 Accuracy of AI Output

Artificial intelligence and machine learning are rapidly evolving fields of study. Given the probabilistic nature of machine learning, use of our Services may in some situations result in incorrect Output that does not accurately reflect real people, places, or facts. You should evaluate the accuracy of any Output as appropriate for your use case, including by using human review.

4. Intellectual Property Rights

The Services, including but not limited to the Emotix platform code, design, logos, and improved algorithms (excluding your specific Input and Output), are the exclusive property of Emotix and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes.

5. Payment and Subscription

Certain aspects of the Services may be provided for a fee or other charge. If you elect to use paid aspects of the Services, you agree to the applicable pricing and payment terms. We may change our prices at any time, but we will provide you with reasonable notice of any such price changes.

6. Prohibited Activities

You agree not to use the Services to:

• Generate content that is illegal, harmful, threatening, abusive, harassment, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
• Reverse engineer, decompile, or dismantle any aspect of the Services.
• Use the Services to develop a competing product or service.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EMOTIX EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY.

IN NO EVENT SHALL EMOTIX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
